. the question may now be when, not if, the republicans will cave on taxes. joining me now is dana milbank, columnist for "the washington post." he's writing about the republicans waving tax hikes and cynthia tucker and visiting professor of journalism at the university of georgia. thanks to both of you for being here tonight. >> hi, reverend. >> good to be here, reverend. >> dana, are republicans really ready to cave? >> well, reverend, first of all, terrific particular to see you and ann coulter on the same page. they've caved already. they have said, we're going to agree to an $800 billion tax increase. it's entirely possible that they are going to go off the cliff any way. it doesn't mean that a deal is imminent. it basically means that they surrender. they used to say that they wouldn't give a dime of tax increase for spending cuts. now they are saying, let's go and do it if we can get $3 of taxes for spending cuts. >> the choice may be down to, do they make the deal before the deadline or do they let it go over the cliff and then come back and vote the tax cuts for the medical class

. joining me now, dana bash, jessica yellin, and david gergen. what's the latest? >> reporter: they are a long way from a deal. but late today speaker boehner and president obama did speak to one another on the phone. now, this is an important development because it's the first time they've talked in a week about the fiscal cliff. i am told, though, that there was no real progress in negotiations. in this sense there was no breakthrough on that central point of tax rates. as you know, president obama insists there is no deal unless the gop agrees to raise rates on the top 2% of earners. the gop says that's a nonstarter. and the two men have not moved from that basic position. now, all of this comes at the same time treasury secretary geithner also said for the first time the administration would be willing to go over the fiscal cliff if the gop does not agree to raise those rates. this was treasury secretary geithner earlier today on cnbc. >> is the administration prepared to go over the fiscal cliff? >> oh, absolutely. there's no prospect to an agreement that doesn't involve

be a first in the country. dana? >> so phil, the chief now answers to this compliance officer instead of the mayor. where is the mayor in all of this? >> reporter: the mayor is going to be right next to the chief because the compliance officer is going to not only be telling the chief what to do working with the chief on these matters but will have the direct say of the court, as well. they will be able to go with the court. the mayor is going to be quite honestly for this purpose off to the side. what oakland did however get away from was the courts coming in with a complete takeover of the department and that could have even led to the court saying you don't have enough cops on the street, you need to hire more. but for right now, it's strictly on the officers conduct not what's going on on the street in terms of crime. >> so the full takeover is still potentially on the table? >> reporter: it is. that's right. that's next. if this doesn't work, that could be, as well. >> , thank you, phil matier in oakland. >>> a recount in alameda county is called off. this is a story we first to

found. good evening i'm ken bastida. does and i'm dana king. the couple have been missing since last week's storm. they were found in the snow. roderick and his girlfriend paula lain were last seen at this 7-eleven before leaving for nevada. 15 minutes ago we learned that a relative who was looking for the couple found paula. she was found crawling in the snow. tonight she is in the hospital. the condition of her boyfriend is not yet known. it appears the couple got snuck in the snow and roderick throat get help. he never returned to the car. investigators spoke just a few minutes ago. >> they may have been sightseeing and got stuck in the snow. reports are that they may have stayed in the vehicle for at least one night. roderick left the vehicle to seek help. when he did not return paula left to seek help. >> paula is in stable condition with mild frostbite. no official word yet about what happened to her boyfriend. >> developing news tonight. silicon valley tycoon john mcafee is under arrest. he's been on the run since early november, refusing to turn himself in to authorities in b

no previous indication he might quit now. i want to go to dana bash joining me on the phone here. dana, huge surprise to a lot of people. what's behind the resignation. >> reporter: a huge stunner. nobody saw it coming. i was told by a source close to demint he didn't accept the job until yesterday telling the staff this morning, called the governor in south carolina who, of course, will have to appoint the successor and told the republican leaders here. but look. the reason why it's such a surprise is because demint really has been over the past few years somebody who takes pride in his job. and the role that any one senator can do, which is to gum up the works and very much, obviously, an inside job. he said he could be better outside than inside an he said he feels better about leaving because he has been able to get a number -- really, half a dozen tea party-like conservatives elected. >> let me jump in, dana. i want to run through them because, you know, when we think senator demint we think of a tea party stronghold within the u.s. senate and helped and also hurt a number of republican

feeling now? i saw one of my colleagues tweeted a -- i don't get the "washington post," but dana milbank said republicans are raising a white flag as big as a bed sheet. is that how you see it? >> it is interesting if you look at the negotiations that president obama offered this massive tax increase with no concessions and this sort of outrageous request on the debt limit which was a really aggressive first offer. and then the republican s countered with a moderate reasonable plan exactly modeled after a proposal by erskine bowles. so if you're trying to handicap the negotiations, you'd have to concede that dana is on to something. >> really. so -- >> at least like the starting point. so basically the starting point for the republicans is what president obama probably would have viewed as a victory if they had the negotiation. >> yeah, he wanted another 400 supposed supposedly. how does simpson-bowles get to -- how does it raise revenue? what's the number that it raises? >> well, it depends because they have a bunch of different simpson-bowles plans. like in the bowles-simpson report, t

. leading member of the tea party. he'll take over the head of the heritage foundation. cnn's dana bash live on capitol hill with more. why did senator demint decide to step down? >> we're trying to get more information from his aides. maybe find him in the hallways here. it's a bit of a surprise because demint has felt that he's been able to be effective here in congress because he has been kind of a conservative very willing to push his own leadership in ways that often times they don't want to be pushed with regard to deficit reduction, with regard to strict fiscal policy. that's by far his number one issue. i can tell you he's also really angered republican leaders over the past two election cycles by raising millions of dollars, a lot of money, for republican candidates who "establishment" thought were less able to win the general election. he is a purist. he's an anti-tax, anti-government purist. it does seem that he's kind of had it here. he wouldn't be the only one to say that they don't feel they can get enough done from the inside and it's probably better to go to the house. we'll
